These terms govern the use of our website. We've written them as plainly as we can — but they are still a binding agreement, so please read them.

These Terms of Use (“Terms”) govern your access to and use of www.evercarehomehealth.net (the “Site”), operated by EverCare Home Care, LLC (“EverCare,” “we,” “us,” or “our”). By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

1. About EverCare

EverCare is a Michigan-based non-skilled home care agency specializing in in-home memory care for adults living with Alzheimer's disease, dementia, and related cognitive conditions, with services including personal care, companion care, and homemaker support, provided to clients in Oakland, Macomb, and Wayne counties, Michigan. We do not provide skilled nursing, therapy, medical diagnosis, or any service requiring a physician's plan of care, and we are not Medicare-certified.

Nothing on the Site creates a caregiver-client relationship, an employer-employee relationship, or a service contract. A formal agreement is required before EverCare provides any services.

2. Eligibility

You must be at least 18 years old and able to form a binding contract under applicable law to use the Site. By using the Site, you represent that you meet these requirements.

3. Permitted Use

You may use the Site for personal, non-commercial purposes related to learning about, contacting, applying for employment with, or engaging EverCare for home care services.

You agree not to:

Use the Site in any way that violates federal, state, or local law
Submit false, misleading, or fraudulent information through any form on the Site
Impersonate any person or entity
Attempt to gain unauthorized access to the Site, our servers, or any associated systems
Introduce viruses, malware, or other harmful code
Use automated tools (bots, scrapers, crawlers) to access or copy Site content without our written permission
Interfere with the Site's operation or any other user's use of the Site
Reproduce, duplicate, copy, sell, or exploit any portion of the Site for commercial purposes without our written permission
Use the Site to harass, threaten, defame, or harm any person

We reserve the right to terminate or restrict your access to the Site at any time, with or without notice, for any reason.

4. Intellectual Property

All content on the Site — including text, graphics, logos, images, photography, video, audio, software, and the overall design — is owned by EverCare or its licensors and is protected by U.S. copyright, trademark, and other intellectual property laws.

“EverCare Home Care” and our logos are trademarks of EverCare Home Care, LLC. You may not use our names, logos, or other marks without our prior written permission.

You may view, print, and download Site content for personal, non-commercial purposes only, provided you keep all copyright and other proprietary notices intact.

5. User Submissions

If you send us a message, application, testimonial, review, or other submission through the Site or by email, you grant EverCare a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, edit, and display that submission for purposes of providing, promoting, and improving our services. You represent that you own or have the rights to share any submission you provide and that your submission does not infringe anyone's rights.

6. No Medical Advice

The Site provides general information about home care, aging, and related topics. It is not medical, legal, financial, or professional advice and is not a substitute for consultation with a licensed physician, attorney, or other qualified professional. Never disregard professional advice or delay seeking it because of something you read on the Site. If you are experiencing a medical emergency, call 911.

EverCare does not provide medical care, diagnosis, treatment, prescriptions, or any service requiring a licensed clinician.

7. Third-Party Links and Services

The Site may include links to third-party websites or services. We do not control and are not responsible for the content, privacy practices, or availability of any third-party site. Your use of third-party sites is at your own risk and subject to those sites' terms.

8. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, EVERCARE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

EVERCARE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Some jurisdictions do not allow the disclaimer of certain warranties, so some of the above may not apply to you.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EVERCARE AND ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR PERSONAL INJURY, ARISING FROM OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SITE, EVEN IF EVERCARE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

EVERCARE'S TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

The limitations in this section do not apply to liability that cannot be excluded or limited under applicable law.

10. Indemnification

You agree to defend, indemnify, and hold harmless EverCare and its owners, employees, agents, and affiliates from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising from (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.

11. Governing Law and Venue

These Terms and any dispute arising from or related to your use of the Site are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles. You agree that any action arising from or related to these Terms will be brought exclusively in the state or federal courts located in Oakland County, Michigan, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms at any time. The “Last Updated” date at the top reflects the most recent changes. Material changes will be flagged on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other notices posted on the Site, constitute the entire agreement between you and EverCare regarding your use of the Site and supersede all prior agreements.
